Questions Answered: Legal, Contracts, and IP – Zoom Meeting with Briffa

During the lockdown, Briffa is working with Portobello Business Centre to provide advice and support to business on everything from IP rights to commercial contracts disputes. The aim of this session is to think about proactive and reactive steps that businesses can take to protect and strengthen their businesses over the coming months. We will aim to cover:

Proactive steps:

o Spending less time working ‘in’ your business. Use the time to work ‘on’ your business
o Think about the future and tackle things that have been ‘on the long finger’ which you now have time to address e.g. getting your legal documentation in order
o Think about long-term returns on investments made now e.g. £500 invested in a trademark will protect your brand for 10 years

Reactive steps:

o Understand your options for avoiding expensive contractual obligations – early termination rights, force majeure rights, contractual frustration
o Leverage these options in negotiation – disputes are expensive for everyone, aim to resolve disputes quickly and inexpensively
o Continue to police and respond to infringement – infringers love chaos, but remain vigilant during the down time
